Construction disputes arise on construction projects in varying degrees. Some common causes of construction disputes are: differing site conditions, engineering design errors, unclear contract terms, scope changes, budget & schedule overruns, quality of construction, and payment terms but there are many other causes. Many times, they can be resolved among the project team but at times, require the legal process which may include mediation, arbitration, or going to court. Construction claims are challenging for all participants and could be costly (time to prepare and present the documentation, legal costs, etc.). The best strategy, to the extent possible, is to keep the lines of communication open and attempt to resolve disputes as they surface, however, this is not always achievable.
Please perform research on an actual construction dispute, summarize the relevant issues, case outcome if available, and your opinions on the case issues. Based on your own experiences, please include your thoughts and opinions on the case and strategies you would have considered if you were involved. Please also include any recommendations you may have to resolve the dispute.
The submission will be a 2-page paper (1.5 spacing, 1” margins, 12 pt font) and include a cover sheet and a reference page with a minimum of two references (four page total submission).
